No. A covered employee is legally entitled to
minimum wage and overtime pay calculated in
accordance with the federal Fair Labor Standards
Act (FLSA). The employee does not have the power
to waive those requirements.
If an employer is not paying minimum wage or
overtime pay because it believes its employees
have waived their right to such pay, it is
mistaken and could have significant back-pay
liability.
